Terms of Use
1. Acceptance of Terms
By accessing or using Linkyanga ("we," "our," or "us"), including our website, mobile application, and any related services (collectively, the "Platform"), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Platform.
These Terms constitute a legally binding agreement between you and Linkyanga. Your continued use of the Platform constitutes your acceptance of any modifications to these Terms.
2. Eligibility
To use our Platform, you must:
- Be at least 18 years old or the age of majority in your jurisdiction
- Have the legal capacity to enter into a binding agreement
- Provide accurate and complete registration information
- Not be prohibited from using our services under applicable laws
- Be a resident of Malawi or have a valid shipping address in Malawi
3. Account Registration
To access certain features of our Platform, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your password
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
- Not create multiple accounts or impersonate others
- Security Tip:
- We recommend using a strong, unique password and enabling two-factor authentication when available.
4. Orders and Payments
When you place an order through our Platform:
- You agree to pay all charges associated with your order
- All prices are in Malawian Kwacha (MWK). A transaction fee is applied at checkout to cover payment processing charges. This fee is calculated using a gross-up method:
Total Payable = Product Price ÷ (1 − 1%)
The calculated amount may be rounded up to the nearest whole MWK for simplicity. The displayed amount is the final payable price, and no additional charges will be applied at payment. The processing charge is non-negotiable and applies to every transaction processed through the Platform.
- We reserve the right to refuse or cancel any order for any reason
- All payments are processed through OneKhusa Payment Gateway that utilizes approved payment methods like; bank transfer and mobile money
- Orders will only be processed after payment is verified
5. Shipping and Delivery
Shipping and delivery terms:
- Free delivery applies only within MUBAS and Blantyre CBD unless LinkYanga explicitly enables other zones
- Orders delivered to addresses outside free-delivery zones will incur a delivery fee, paid by the customer
- Shipping costs, if any, will be covered by the customer
- Delivery times are estimates and not guaranteed
- Risk of loss passes to you upon delivery
- You are responsible for providing accurate delivery information
- We are not liable for delays caused by circumstances beyond our control
6. Returns and Refunds
Our return and refund policy:
- Returns are accepted within 7 days of delivery for defective products
- Products must be unused and in original packaging
- Refunds will be processed after inspection of returned items
- Shipping costs for returns are your responsibility unless the product is defective
- Digital products and perishable goods are non-refundable
7. Intellectual Property
All content on our Platform, including but not limited to text, graphics, logos, images, software, and trademarks, is the property of Linkyanga or its licensors and is protected by copyright and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content without our prior written consent.
8. Prohibited Activities
You agree not to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Upload malicious code or attempt to breach our security
- Interfere with the proper functioning of our Platform
- Engage in fraudulent or deceptive practices
- Scrape, crawl, or use automated systems to access our Platform
- Harass, abuse, or harm other users
9. Privacy Policy

By using our Platform, you consent to the collection and use of your information as described in our Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by law, Linkyanga shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of our Platform.
Our total liability to you shall not exceed the amount you paid for the product or service giving rise to the claim.
11. Termination
We reserve the right to suspend or terminate your account and access to our Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the Platform will immediately cease, and we may delete your account and associated data.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Malawi, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malawi.
13. Changes to Terms
We may modify these Terms at any time by posting the updated version on this page. The "Last Updated" date at the top of this page indicates when the latest changes were made. Your continued use of the Platform after any changes constitutes your acceptance of the modified Terms.
